E-Discovery Funnel: 3 - Extract

Some sources of potentially responsive data cannot, or should not, be taken out of service but may contain data that is subject to rapid overwriting or loss.  After you identify these in Stage 1, immediately extract and secure potentially responsive ESI.  Usually, this means making copies of home directories, group folders, and email.  Forensic imaging of selected workstations or laptops is also common.
  • Demand digital-legal expertise
  • Extract potentially responsive data while preserving metadata
  • Understand the differences between "imaging" and "copying" data and make informed decisions for each extraction
  • Remember that in-use ESI is at high risk for alteration, destruction, costly "do-overs," and court sanctions
  • Continually monitor, test, and document
