E-Discovery Functions: 4 - Sort/Cull

This is the first step in actually processing the potentially responsive data so that it can be reviewed and, ultimately, produced.  This function may occur months or even years after the initial assessment, securing of sources of ESI, and extraction of data from other identified potential sources.
  • Demand tech-legal expertise
  • Understand the objective of sort/cull:
    -Rehabilitate/reconstruct damaged files
    -Restore archival media to fully searchable status
    -Cull clearly extraneous files (system files, duplicates, spam email)
    -Archive and document any files that are “removed” from searchable set
  • Collect data into a searchable macro-database
  • Scan paper documents (and process through OCR application) and include into the searchable macro-database
  • Continually monitor, test, and document
