The goal of this one-hour course is to provide attendees with a comprehensive plan to facilitate cost shifting, cost sharing and cost minimization when undertaking electronic discovery.
Every client desires that the other party pay for the expense of conducting electronic discovery. In fact, this is appropriate in some circumstances, but too often counsel’s discovery tactics fail to position a cost shifting motion to the client’s best advantage.
This course will discuss how to effectively plan and implement the most effective cost shifting, sharing and minimization strategies by:
(i) keeping appropriate documentation; (ii) communicating appropriately with opposing counsel; (iii) inviting the other party to contribute to the search process at an early stage; and (iv) aligning the client’s case with reported decisions on cost shifting.
